Welcome to Hawaii Monthly Rental. These Terms of Use (“Terms”) apply to your use of hawaiimonthlyrental.com (the “Site”). By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.

1. What We Are, and What We Aren’t

Hawaii Monthly Rental is an online directory and information resource for furnished homes and condos available for extended stays in Hawaiʻi. We help renters and property owners find each other.

• We are not a party to any rental. Any rental agreement is solely between the renter and the owner or property manager.
• We are not a real estate broker, agent, or property manager, and we don’t represent renters or owners.
• We don’t process bookings or payments, hold deposits, or collect rent.
• We don’t inspect, own, or manage any listed property, and we don’t verify every detail of every listing.

2. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use the Site.

3. Information on the Site

Our island guides, minimum-stay information, and resource lists are general information only. They are not legal, tax, or financial advice. Rental rules, permits, and taxes vary by county and change over time. Always confirm requirements with the appropriate county or state agency, or a qualified professional, before acting on them.

4. Listings and Owner Responsibilities

If you submit a property to the Site, you confirm that:

• You own the property or are authorized to rent it on the owner’s behalf
• Your listing is accurate and current, including the rate, minimum stay, availability, and photos
• Your rental complies with all applicable laws and rules, including county zoning and minimum-stay rules, any required permits or registrations, Hawaiʻi tax obligations, fair housing laws, and your HOA or building rules
• You have the rights to all photos and content you submit
• You will respond to inquiries honestly and won’t use the Site to mislead or defraud anyone

You are solely responsible for your listing and your rental. We may review, edit for format, decline, or remove any listing at any time, for any reason, including if we believe it doesn’t comply with these Terms or the law.

5. Renter Responsibilities

Listings are provided by owners and managers. Before you commit to a rental, do your own due diligence: verify the property and the person you’re dealing with, review the rental agreement carefully, and confirm the rate, deposit, and minimum stay in writing.

Protect yourself from scams. Never wire money or pay with gift cards to hold a rental, and be cautious of prices far below the market or pressure to pay before seeing an agreement. If something seems wrong, please report it to us.

6. Fees

Listing on the Site is currently offered at no cost during our launch period. We may introduce paid or featured listing options in the future. If we do, we’ll tell listed owners before any fees apply, and paid features will be subject to additional terms.

7. Content You Submit

You keep ownership of the content you submit, such as property descriptions and photos. By submitting it, you give us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, format, and promote that content on the Site and in marketing for the Site while your listing is active and for a reasonable time after. You can ask us to remove your content at any time.

8. Our Content

The Site’s design, text, guides, logos, and other original content belong to Hawaii Monthly Rental or our licensors. You may view and share links to our pages for personal, non-commercial use. Please don’t copy, republish, or scrape our content without permission.

9. Prohibited Uses

You agree not to:

• Post false, misleading, or fraudulent listings or information
• List a property you aren’t authorized to rent, or one that doesn’t comply with the law
• Discriminate against anyone in violation of fair housing laws
• Use the Site to send spam, harass others, or collect other users’ information
• Scrape, copy, or harvest content or data from the Site using automated tools
• Interfere with the Site’s security or operation, or attempt to access it without authorization

10. Third-Party Links

The Site links to county, state, and other outside websites for your convenience. We don’t control those sites and aren’t responsible for their content, accuracy, or practices.

11. Disclaimers

The Site and all content and listings are provided “as is” and “as available,” without warranties of any kind, express or implied. We don’t guarantee that listings are accurate, available, legal, or suitable for you, or that the Site will be uninterrupted or error-free. We aren’t responsible for the conduct of any owner, manager, or renter, or for the condition of any property.

12. Limitation of Liability

To the fullest extent permitted by law, Hawaii Monthly Rental and its owners, team members, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from a rental, a listing, or your dealings with another user. Our total liability for any claim related to the Site will not exceed the greater of the amount you paid us in the 12 months before the claim, or $100.

13. Indemnification

You agree to defend and hold harmless Hawaii Monthly Rental and its owners and team members from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your listing, your rental, your content, or your violation of these Terms or the law.

14. Suspension and Termination

We may suspend or end your access to the Site, or remove your content, at any time if we believe you’ve violated these Terms or to protect the Site and its users.

15. Governing Law

These Terms are governed by the laws of the State of Hawaiʻi, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Hawaiʻi, and you agree to the jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms as the Site grows. When we do, we’ll change the effective date at the top of this page. Continuing to use the Site after an update means you accept the revised Terms.

17. General

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and our Privacy Policy are the entire agreement between you and us about the Site.
